Who Is Eligible For An H-1B1 Visa?

The role must require a bachelor’s degree or higher in a specific field, and the employee should possess the necessary qualifications. As the employer, you will need to file a Labor Condition Application (LCA). This legal document attests that hiring the foreign national employee will not negatively influence wages or working conditions of U.S. employees who are working in similar roles and positions.
How Long Is An H-1B1 Visa Valid?
The H-1B1 visa is initially valid for up to 18 months. However, it can be renewed indefinitely in increments of up to 18 months, as long as the employee continues to meet the eligibility requirements and maintain their employment with you as the sponsoring employer. If you anticipate that your employee will need an extension, it is important to plan ahead and apply for extensions before the current visa expires.
