Massachusetts Employment Immigration: Applying For An H-1B1 Visa

Employment visas allow U.S. companies to bring employees into the country for specific jobs. However, the U.S. immigration system can be overwhelming, especially when it comes to knowing which visa to apply for and use.

My name is John G. Cayer. I founded my firm, Cayer Law in Beverly, to help businesses and employers secure the right visas for their executives and international talent. As an employment immigration lawyer, I work closely with clients in Boston and surrounding areas of Massachusetts to simplify this process and help you achieve your employment and immigration goals.

What Is An H-1B1 Visa?

An H-1B1 visa is a non-immigrant visa specifically designed for citizens of Chile and Singapore, providing them the opportunity to work in the United States in a specialty occupation. This type of visa is part of a trade agreement between the U.S. and these countries. It allows professionals to work temporarily in roles that require specialized knowledge. Professionals using the H-1B1 visa will need a bachelor’s degree or equivalent in their field.

Who Is Eligible For An H-1B1 Visa?

To be eligible for an H-1B1 visa, the employee must be a citizen of Chile or Singapore and have a job offer from a U.S. employer in a specialty occupation. The role must require a bachelor’s degree or higher in a specific field, and the employee should possess the necessary qualifications. As the employer, you will need to file a Labor Condition Application (LCA). This legal document attests that hiring the foreign national employee will not negatively influence wages or working conditions of U.S. employees who are working in similar roles and positions.

How Long Is An H-1B1 Visa Valid?

The H-1B1 visa is initially valid for up to 18 months. However, it can be renewed indefinitely in increments of up to 18 months, as long as the employee continues to meet the eligibility requirements and maintain their employment with you as the sponsoring employer. If you anticipate that your employee will need an extension, it is important to plan ahead and apply for extensions before the current visa expires. An experienced employment immigration lawyer can help you file an extension.
